Terms of Use for AI Twin by OpenHome

1. Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and OpenHome Technologies Inc (“OpenHome,” “we,” or “us”) governing your access to and use of the AI Twin by OpenHome mobile application (the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

2. User Accounts and Eligibility

Use of the App is permitted without the creation of a user account; however, access to certain features, including the ability to save or share your AI Twin, may require registration via email, Google, or Apple authentication. By using the App, you affirm that you are at least thirteen (13) years of age and have the legal capacity to enter into and comply with these Terms.

3. Ownership and Use of User Content

You acknowledge and agree that all AI-generated content within the App, including but not limited to AI Twins, voice clones, and related outputs, are owned by OpenHome Technologies Inc. By uploading content, including voice recordings, personal information, and other data, you hereby grant to OpenHome a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, distribute, publish, translate, and create derivative works from such content for the purposes of operating, improving, marketing, and further developing the App and associated services.

You retain the right to share your AI Twin through sharable URLs or other mechanisms provided by the App. Any such content you choose to share is shared at your own discretion and risk.

4. Voice Cloning and Legal Responsibility

You are solely responsible for ensuring that you have obtained all necessary rights and permissions to upload and clone any voice using the App. You shall not upload, generate, or use voice content that impersonates another individual without their explicit consent, nor shall you use the App to create deepfakes or engage in any form of deceptive or unauthorized commercial use of voice content.

OpenHome reserves the right to suspend or terminate your access to the App, without notice, for any violation of these Terms or misuse of the voice cloning functionality.

5. Content and Conduct

You agree to use the App in compliance with all applicable local, state, national, and international laws and regulations. You further agree not to harass, threaten, or impersonate others; not to upload, distribute, or otherwise make available content that is offensive, harmful, or misleading; and not to attempt to copy, reverse-engineer, or otherwise misuse the App or its underlying systems.

6. AI Disclaimers

The App makes use of artificial intelligence, machine learning models, and third-party AI services to generate responses, behaviors, and personality traits for your AI Twin. You acknowledge that such content is generated automatically and is intended solely for entertainment and experimental purposes. The content produced by your AI Twin is not guaranteed to be accurate, factual, reliable, or appropriate for real-world decision-making. OpenHome disclaims any and all liability arising from your reliance on AI-generated content.

7. Third-Party Services

The App may integrate or rely on third-party services, including but not limited to APIs and infrastructure provided by companies such as OpenAI, ElevenLabs, and Deepgram. Your use of such features may be subject to those providers’ own terms and policies.

Specifically, with regard to ElevenLabs, by submitting your voice data through the App, you acknowledge that such data may be used by ElevenLabs to deliver and improve their services. ElevenLabs is granted a perpetual, irrevocable, non-exclusive, royalty-free, and worldwide license to use your voice data for such purposes. ElevenLabs will not commercialize your voice as a standalone product without your explicit consent. You remain solely responsible for ensuring that you have legal rights to any voice data you submit.

8. Termination

OpenHome reserves the right to suspend or terminate your access to the App, in whole or in part, at any time and for any reason, including but not limited to violations of these Terms. You may delete your account or request data deletion at any time by contacting us at legal@openhome.xyz.

9. Subscriptions and Pricing

The App is currently offered free of charge. OpenHome reserves the right to introduce premium features, in-app purchases, or subscription services in the future. Any such offerings will be clearly disclosed prior to purchase, and these Terms may be updated accordingly at that time.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to any conflict of law provisions. In the event of any dispute arising from or relating to these Terms or your use of the App, the parties agree to attempt to resolve such disputes informally. If informal resolution is unsuccessful, the dispute shall be submitted to a court of competent jurisdiction located in the State of Florida or resolved through arbitration as permitted by applicable law.

11. Modifications to Terms

OpenHome may revise or update these Terms at any time at its sole discretion. We will notify users of material changes by updating the “Effective Date” at the top of this document. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
